High court has options on health care law

WASHINGTON (AP) ? The arguments are done and the case has been submitted, as Chief Justice John Roberts says at the end of every Supreme Court argument. Now the justices will wrestle with what to do with President Barack Obama's health care overhaul. They have a range of options, from upholding the law to striking it down in its entirety. The court also could avoid deciding the law's constitutionality at all, although that prospect seems remote after this week's arguments.

A look at six potential outcomes, from the simplest to the most complicated possible rulings:

Q. What if the Supreme Court upholds the law and finds Congress was within its authority to require most people to have health insurance or pay a penalty?

A. A decision in favor of the law would end the legal fight and allow the administration to push forward with implementing its provisions over the next few years, including the insurance requirement, an expansion of Medicaid and a ban on private insurers' denying coverage to people with pre-existing health problems.

The political wrangling, however, probably would continue as candidates for Republican presidential nomination and lesser offices are calling for repeal of the law.

Q. What if, on the other hand, the court strikes down the entire law?

A. That would kill a costly new federal entitlement before it has a chance to take root and develop a constituency of beneficiaries and supporters, namely more than 30 million people who are supposed to wind up with health insurance because of the law.

In addition, some parts of the law already are in effect and would be rolled back. One popular provision allowing young adults to stay on their parents' insurance until age 26 has added nearly 2.5 million people to the coverage rolls, at no cost to taxpayers.

But there's no escaping America's double-barreled problem of excruciatingly high health care costs and many uninsured people, more than 50 million according to the latest estimates.

Whether it's dealing with the federal deficit, retirement security for seniors or even the Pentagon budget, elected officials would still have to confront health care at nearly every turn.

Congress would get to roll the ball up the hill again.

Q. What happens if the court strikes down the individual insurance requirement, but leaves the rest of the Affordable Care Act in place?

A. Knocking out the requirement that Americans carry insurance would not be the end of Obama's health care overhaul. There's a lot more in the 900-plus pages of the law.

But it would make the complicated legislation a lot harder to carry out, risking more complications for a U.S. health care system already seen as wasteful, unaffordable and unable to deliver consistently high quality.

Ten million to 15 million uninsured people who would have gotten coverage under the law could be left out.

The cost of individually purchased private health insurance would jump. That would make it more expensive for the government to subsidize premiums, although millions of middle-class people would still be entitled to such assistance under the law's remaining provisions.

If the individual mandate is struck, the law's Medicaid expansion would still cover millions more low-income people, mainly childless adults.

And a host of other mandates would stay in place. Starting in 2014, medium-sized and large employers would be hit with fines for not providing coverage to their workers.

Insurance companies would be required to accept people with pre-existing medical problems, no longer allowed to cherry-pick the healthy to keep costs down. They would also be barred from imposing higher premiums on people in poor health and limited in what they could charge older adults.

If that happens, premiums in the individual health insurance market would jump anywhere from 10 percent to 30 percent, according to various forecasts from economists.

Experts debate whether or not such a cost spike would trigger the collapse of the insurance market for individuals and small businesses ? or just make coverage even more expensive than it already is.

"Without a mandate the law is a lot less effective," said MIT economist Jonathan Gruber, who advised the Obama administration and, earlier on, then-Massachusetts Gov. Mitt Romney, who put such an insurance mandate in that state's health care law. "The market will not collapse, but it will be a ton more expensive and cover many fewer people."

Q. What if the court strikes down the mandate and invalidates the parts of the law that require insurance companies to cover people regardless of medical problems and that limit what they can charge older people?

A. Many fewer people would get covered, but the health insurance industry would avoid a dire financial hit.

Insurers would be able to continue screening out people with a history of medical problems, such as diabetes patients or cancer survivors.

That would prevent a sudden jump in premiums. But it would leave consumers with no assurance that they can get health insurance when they need it, a major problem the law was intended to fix. Other economically developed countries guarantee health insurance for their citizens.

A related requirement limits premiums charged to older adults. Currently people in their late 50s and early 60s can face premiums as much as six or seven times higher than those charged to 20-year-olds. The law says insurers may charge older adults no more than three times what they charge younger ones.

Administration lawyers say the insurance requirement goes hand in hand with the coverage guarantee and cap on premiums, and have asked the court to get rid of both if it finds the mandate to be unconstitutional.

Q. What happens if the court throws out only the expansion of the Medicaid program?

A. Throwing out the expansion would severely limit the law's impact because roughly half of the more than 30 million people expected to gain health insurance under the law would get it through the expansion of Medicaid, the federal-state health insurance program for low-income people.

The law would effectively bring under Medicaid everyone making up to 138 percent of the federal poverty level. That works out to about $15,400 for an individual, $30,650 for a family of four. Most of those who would be added to the Medicaid rolls are low-income adults without children.

But a potentially sizable number of those low-income people might still be eligible for government-subsidized ? though probably more expensive ? private insurance under other provisions of the law. Private coverage will probably be more expensive for taxpayers to subsidize than Medicaid.

States suing to overturn the federal law argue that the Medicaid expansion comes with so many strings attached it amounts to an unconstitutional power grab by Washington, reaching directly into the wallets of state taxpayers.

The administration counters that the federal government is paying all of the initial cost of the expansion and 90 percent in perpetuity, well above what Washington contributes for regular Medicaid. Moreover, when Congress created Medicaid in 1965 it also served notice on the states that program rules could change in the future. This is only the latest of many such changes.

The Supreme Court took on this issue even though none of the district or appeals courts that heard health care lawsuits had any problem with the Medicaid expansion.

"We don't have any lower court that has struck down this (Medicaid) provision, so there is no precedent from the lower courts on how to handle it," said Diane Rowland, a Medicaid expert with the nonpartisan Kaiser Family Foundation. "They all upheld it."

Q. What happens if the court decides that the constitutional challenge is premature?

A. The wild card, and least conclusive outcome in the case, probably also is the least likely, based on what justices said during the arguments. No justice seemed inclined to take this path, which involves the court's consideration of a technical issue. The federal appeals court in Richmond, Va., held that the challenge to the insurance requirement has to wait until people start paying the penalty for not purchasing insurance. The appeals court said it was bound by the federal Anti-Injunction Act, which is intended to facilitate tax collections and keep the government operating. That law says federal courts may not hear challenges to taxes, or anything that looks like a tax, until after they are paid.

It remains at least possible that if the justices have trouble coming together on any of the other options they could simply decide not to decide the big issues.

Although the administration says it doesn't want this result, such a decision would allow it to continue putting the law in place and force postponement of any subsequent challenge until more of the benefits are being received. On the other hand, Republicans might have more ammunition to press for repeal of the law in the meantime.

The director is now in final negotiations to direct the sci-fi disaster film Invertigo. The story concerns a long-lost NASA space probe under the influence of ?dark energy? that mysteriously crashes on earth and proceeds to disrupt and reverse the pull of gravity. Skyscrapers and bridges are ripped from the ground and rivers ?rain from the sky? as a team mounts a mission into upside-down Manhattan to avert the planet?s destruction. d-j-caruso-invertigoI can handle action movies that ask the audience to take a leap of faith, but there?s a certain point at which the ridiculous becomes just absurd. If Earth?s gravitational pull was reversed and buildings were ripped from the ground, why the hell wouldn?t they float into outer space? Is there a surprise forcefield surrounding Earth?s atmosphere that catches everything in the event of a gravitational emergency? I?m assuming some plot device is introduced to explain why everything stops once it hits the sky, but I find it hard to imagine that they?ve come up with something that could be remotely considered ?conceivable.?

Per Heat Vision, Sony already has a release date set for the project, March 7th, 2014, and Neal Moritz (the Fast and Furious franchise) is onboard as producer with Ehren Kruger (Transformers: Revenge of the Fallen) and Bradley Camp writing the script. I was a big fan of Caruso?s Disturbia but I found Eagle Eye to be lacking and I Am Number Four to be atrocious (though mainly due to story/source material issues). The guy?s got promise, and maybe he?ll turn Invertigo into a fun, successful disaster pic, but I?m gonna find it really hard to get past the scientific ramifications of the story.

Planning Ahead: The Roth IRA

Retirement planning is boring. There is no other way to put it. But at the end of the day ? or career, it is what matters. So let?s continue taking care of it now, so we?ll be ok later. Hopefully you have already checked out the piece on the importance and benefits of investing in your company?s 401(K). If not jump over to Planning Ahead: The 401(K), and read through it. If you have already read it and better yet already started contributing to your available 401(K) ? great. You are already heading down the road to living rich. But don?t think that simply contributing to your 401(K) will be enough to live out your retirement dreams. The days of retiring and receiving social security benefits alongside your 401(K) are pleasantries that our generation just won?t have t. To help ensure complete financial freedom during our golden retirement days, we have to do more. After contributing the max of what your employer will match within your 401(K), the next step is outside retirement options. A great place to start is the Roth IRA. Just like the 401(K), before you start investing understand first what it does, how it works and how it works for?you.

Named after Senator William Roth, the Roth IRA (Individual Retirement Agreement) was enacted in 1997 by Congress through the Taxpayer Relief Act. A?Roth IRA? is a special type of retirement plan under US law that is generally not taxed, provided certain conditions are met. Through a Roth IRA your investment options include?securities, usually?common stocks?and?bonds, often through?mutual funds?(although other investments, including derivatives, notes,?certificates of deposit, and real estate are possible).?It?s main difference from other retirement plans is that the money invested into it is deducted from your check after taxes have been taken and then grows tax free. You are then allowed to withdraw your contributions at any time without taxes or penalty. The key word here is contributions. Let?s say you place $2000 into your Roth IRA and successfully invest it so that it grows to $3000. At any point in time you can withdraw that $2000 you contributed but you can?t withdraw that $1000 you gained without incurring tax and an early withdrawal penalty. To withdraw any gains without incurring taxes or penalty fees the Roth account has to be held for at least five years and you must be at least 59 ?. But there are exceptions to this rule. In the case death or disability of the account holder the gains can be withdrawn tax and penalty free or up to $10,000 ?in gains can be withdrawn to purchase a first home for yourself or certain family members. In addition, you can also withdraw earnings early to pay higher-education costs for yourself or a family member and not have to pay the 10% early withdrawal penalty, but will still incur income taxes.

Basically, a Roth IRA makes a lot of sense if you expect your tax rate to be higher during retirement than your current rate. This makes it an ideal option for us (young working individuals) as we can benefit from many years of tax-free, compounded growth.?There is no age limit as you can contribute to a Roth IRA at any age as long as you have earned income from a job, but there are income eligibility limits. If you make too much money, you can?t contribute. Wouldn?t that be a great problem to have? ?Damn man. I can?t even start a Roth IRA because I make too much money!? Haha. No seriously let?s check out the income restrictions. I think the majority of us are safe for now.

For 2012, the maximum you can contribute to a Roth IRA?is $5,000 ?($6,000 if you are age 50 or older by the end of the year) if you are single or the single head of a household and your modified adjusted gross income is less than $110,000. So all of us single individuals who make less than $110k can contribute to a Roth IRA. If you are married and filing jointly, you can contribute the maximum amount ?if your income is less than $173,000. I still think the majority of us fall under these umbrellas. But for those lucky people who don?t, you can make a partial contribution to a Roth IRA if you are single and your income is between $110,000 and $125,000 or if you are married filing jointly and your income is between $173,000 and $183,000. If you make more than that, take your money elsewhere suckers. You can?t contribute to a Roth IRA if your income is above those levels.

This is a just a brief overview to make you aware of the Roth IRA. Talk to others who may be investing in one, do some research via Google, and examine all your options provided by different financial institutions that offer Roth IRAs. Perform your due diligence then select one that works best for you.

BodyMedia Fit Core


The?BodyMedia Fit Core?fitness armband?($179.99, retail, plus $6.95 per month for data access), used to calculate your exercise level and calorie burn, looks unlike other gadgets in its class. Two silver plates on the inside press against your skin to measure body temperature and galvanic skin response (perspiration, essentially). This, coupled with a three-axis accelerometer, helps BodyMedia calculate fairly accurate data. But there are drawbacks: You have to pay a monthly fee to see the data, and the armband itself is clunky, uncomfortable, and not particularly attractive.

BodyMedia Fit Core faces the world strapped to your upper arm, and, unfortunately, it looks like a nugget-sized gray and eggshell-colored chunk of plastic with a small indicator light in the center. The light tells you when the battery is full or low. A rubber button next to the light lets you check whether the device is charged.

The?reverse side, the area that touches your skin, has two silver plates with 10 small raised bumps and one larger bump. (See the slideshow for images.) On one side of the unit, not visible when worn, is a micro-USB port for connecting the BodyMedia to a computer to charge the battery and upload data. You have to connect it to sync the data, as the BodyMedia Fit Core doesn't have any wireless capabilities. There's an iOS and Android app that syncs with the Web-based Activity Manager so that you can see your data and log foods you eat while on the go. You can't sync the device itself to your smartphone, so you can only see the most recently uploaded information.

Another version of the same device, BodyMedia Fit Link ($199.99 direct), is nearly identical in functionality to BodyMedia Fit Core, except that it does have Bluetooth syncing capabilities, as well as slightly more attractive design.

The included armband, also a tinted gray eggshell color, is just a Velcro strap with a plastic ring where the BodyMedia snaps securely into place.?

I used the gadget and the online system, called Activity Manager, for about a week, but three days in, and I decided to wear it overnight it anymore. The first time I slept with the armband on, I awoke to two huge red marks on my arm, which took all day to dissipate. I must have been sleeping on my arm, or positioned in some way to cause excess pressure. However it happened, I was not happy about it.

While wearing it during the day, I constantly readjusted the band, shifting it one way or another so that the metal plates were not in contact with the same patch of skin for too long. It's not the most comfortable thing to wear, and after day four, I was surprised that it felt more noticeable, not less.

At a nice restaurant one evening, I slipped off my cardigan only to have my boyfriend lean over the table and ask, "You're not going to keep that thing on during dinner, are you?" The BodyMedia is hard to ignore. It's in plain sight whenever your arms are exposed and is quite ugly. A light sweater may hide it, but anyone will still easily notice a huge and irregular bulge on one of your biceps.

Set Up and Fitness Information
As with most fitness measuring products, BodyMedia collects more accurate information if you give it a few metrics about yourself to start, such as gender, age, weight, height, and typical activity level (e.g., sedentary, moderately active, very active, etc.).

Out of the box, BodyMedia doesn't know anything about you. Setup involves plugging it into a computer and setting up the Activity Manager where you can enter these metrics, as well as log your food and beverage intake, record your daily weight, and see the statistics that BodyMedia collects. The first three months are free, but paying extra for the Activity Manager seems like an undue charge. Most fitness gadgets include access to the data in the purchase price. And the gadget itself is worthless without the data.

The website structures information well, and I had no trouble finding metrics like the number of steps taken in a day, how silently I slept, and where and how to input foods Id' eaten. The food area could be better, but its problems are typical of those I've seen with other calories-counting apps. The main issue is that it's very easy to log commercially packaged (that is, processed) foods, but tougher to find entries for foods that are minimally processed. For example, in looking for dried peas, I found dozens of branded options for canned peas, but nothing for fresh or dried peas. You have the option to create an entry for a new food or recipe (I logged a homemade spiced tea cake, for example), but I wish there a way to make recipes and new foods logged publicly available for others to share and use. A calorie-counting and fitness-tracking app called MyFitnessPal (free, 4 stars) does just that, and for those of us who eat a diverse diet, the shared information makes the app much better than most others.

As with all fitness gadgets and apps, you have to track both exercise and calories consumed to get good information back. If you don't log one or the other, you might see some very offputting numbers regarding how many calories you should be consuming in order to lose, gain, or maintain weight, depending on your goal (which you can enter in BodyMedia's system). The mobile apps only provide a snapshot of your fitness activity (calories burned, calories consumed, total steps taken, and a few other metrics), but they do let you enter foods that you've eaten throughout the day fairly easily.

Good Data, But It'll Cost You
A much simpler alternative to the BodyMedia Fit Core?is the Fitbit Ultra ($99, 3.5 stars), a tiny, unobtrusive black clip that captures data nearly as well by relying on an intelligent pedometer and altimeter. You have to pay an extra subscription to see that data, however, and with most other devices, free access to that information is included. BodyMedia is also unsightly and uncomfortable, whereas other modern fitness trackers, like the Fitbit Ultra, Nike Fuel Band, and Jawbone UP (the latter two have been sold out almost from the day they reached the market) are sleek and discreet. The Fitbit Ultra is surprisingly useful, and at just $99 should not be overlooked. It's also available widely, making it perhaps the only good option for most people.

One Direction excited about history making debut

NEW YORK (AP) ? One Direction's Niall Horan was in a taxi when he learned that the group's first album, "Up All Night," debuted at the top of the latest Billboard Top 200 albums chart.

So he did what any 18-year-old would do in that situation: "I freaked out."

He immediately started spreading the news with phone calls, but wanted to keep the news from his mom to play a joke on her.

"I wanted to say we had lost out and that whole thing, but Billboard had posted it on their website so my cover was blown," he said Wednesday.

Horan and his band mates have a right to be excited. They sold more than 176,000 copies of the album in its first week of release to reach No. 1. It makes them the first British act to debut at No. 1 with their first album.

Harry Styles, 18, called the news "humbling" in a phone interview.

"We're just five normal boys from the U.K. who've been given this opportunity, so we're having a great time working very hard."

The fans of One Direction have been hard at work as well. Thanks to social media, the group's followers have helped to spread the word about their music.

"It's played a massive part," said Styles. "Twitter, Facebook and YouTube have been a large percentage of the reason we've been known outside of the U.K. ... We owe a massive thank you to the fans."

"Whenever you ask anyone how they know about us, it's always Twitter or Tumblr or something like that," added 20-year-old Louis Tomlinson.

The success of One Direction and other groups like Big Time Rush (who toured together recently) has led industry watchers to believe the boy band is making a comeback, and the guys are proud to wear that "boy band" tag.

"There's nothing wrong with it," says Niall. "We are boys in a band. ... People have it in their head that a boy band, that it's everyone wearing white and sitting on stage. That's one side of it. We're trying to do something else."

One Direction first came together when they all tried out individually for U.K. edition of "The X Factor" in 2010. Judge and mentor Simon Cowell thought they would make an interesting combination instead. The group ended up in third place that season and Cowell signed them to his Syco music label, a division of Sony.

Cowell said the group's success so far makes him feel very proud.

"I desperately wanted (a No. 1 record) for the boys more than anything else," he said. "I'm probably more excited about this than I have been about anything for a long, long time."

The group also announced Wednesday that they will headline their first North American tour beginning May 24 in Fairfax, Va.

Liam Payne, 18, hopes the tour will lead to even more opportunities.

"The ultimate goal would be to do a big, worldwide tour. That would be the most amazing thing we could do."

Powerful new cells created by Cardiff University scientists from cheek lining tissue could offer the answer to disorders of the immune system.

While the body's immune system protects against many diseases, it can also be harmful. Using white blood cells (lymphocytes), the system can attack insulin-producing cells, causing diabetes, or cause the body to reject transplanted organs.

A team from Cardiff's School of Dentistry led by Professor Phil Stephens, with colleagues from Stockholm's Karolinska Institute, have found a new group of cells with a powerful ability to suppress the immune system's action.

The team took oral lining cells from the insides of patients' cheeks and cloned them. Laboratory tests showed that even small doses of the cells could completely inhibit the lymphocytes.

The breakthrough suggests that the cheek cells have wide-ranging potential for future therapies for immune system-related diseases. Existing immune system research has focussed on adult stem cells, particularly those derived from bone marrow. The cheek tissue cells are much stronger in their action.

Dr Lindsay Davies, a member of the Cardiff team, said: "At this stage, these are only laboratory results. We have yet to recreate the effect outside the laboratory and any treatments will be many years away. However, these cells are extremely powerful and offer promise for combating a number of diseases. They are also easy to collect bone marrow stem cells require an invasive biopsy, whereas we just harvest a small biopsy from inside the mouth."

The findings have just been published online in Stem Cells and Development. The team has now been funded by the Medical Research Council to investigate the cloned cells further.

Senate bill could roll back health insurance savings

This summer, health insurance companies may have to pay more than a billion dollars back to their own customers. The rebate requirements were introduced as part of the 2010 health-care reform law and are meant to benefit consumers. But now an insurer-supported Senate bill aims to roll back the rebate requirements.

Known as the medical loss ratio rule, it's actually pretty simple. Under the health-care law provision, 80 to 85 cents of every dollar insurers collect in premiums must be spent on medical care or activities that improve the quality of that care. If not, they must send their customers a rebate for the difference. The goal, according to the Department of Health and Human Services, is to limit the money insurers spend on administrative costs and profit.

"It essentially ensures that consumers receive value for every dollar they spend on health care," HHS spokesman Brian Chiglinsky told ProPublica.

Last month, Sen. Mary Landrieu, D-La.,?introduced a bill that would change what costs companies can include in the 15 to 20 percent they are allotted for overhead, salaries and marketing. The bill, similar to a House bill introduced in March 2011?that has yet to come up for a vote, focuses on payments to insurance agents and brokers. Traditionally, these commissions are bundled into the administrative costs when making the final calculation. But insurance regulators have argued that fees paid to insurance agents and brokers shouldn't count.

Such a change could mean big savings for insurance companies ? and much smaller rebates for consumers.

This is the first year that companies are required to send out rebates. According to a report by state insurance commissioners, if rebates had been handed out last year, insurers would have had to pay consumers almost $2 billion. If they had carved out the broker fees, as proposed in the two current bills, consumers would have gotten only about $800 million.

Landrieu's office did not immediately respond to our call for comment.

"[The bills] would water down the standard to a point where it becomes ineffective," said Sondra Roberto, a spokeswoman for the nonprofit advocacy group Consumers Union. The group, which also publishes Consumer Reports, recently urged members to oppose the bill.

The rebates have gotten relatively modest attention. Only 38 percent of the public is even aware of the rule's existence, according to a Kaiser poll.

Insurance companies have supported the two bills, claiming that the rebate rule, as it stands now, stifles jobs and actually drives up insurance premiums. A 2011 government report found that most insurance companies were, in fact,?lowering their premiums to meet the requirements, as the administration had hoped.

While most insurance companies hit the 80 to 85 percent target, the few that didn't may be required to send out rebates this year.

"Some insurance companies pay an inordinate amount, as much as 40 percent, on administration and profit and not health care," Roberto said.

The rules on rebates differ slightly depending on whether the insurance comes from a large-group plan (employers with more than 100 employees), or a small-group or individual plan. In each case, insurance companies will be required to make all their costs publicly available so consumers can see how their premium dollars are spent.

The government granted insurance companies in seven states extra time to meet the requirements. Insurers that serve states with more rural populations, for example, tend to have higher overhead costs and cannot meet the requirement as easily, according to Eric Fader, a New York health-care lawyer. But the government decided that for all other states, enforcing the requirement wouldn't pose any risk to the market, and that the federal government didn't "need to coddle an inefficient insurance company," Fader said.
